百度与版权方达成音乐下载协议 Baidu reaches music download deal

中国按收入计算最大的在线搜索企业百度(Baidu)与全球三大音乐版权持有人达成了一项免费下载歌曲的协议。这项协议是与万仕达(One Stop China)签署的，后者是环球音乐(Universal Music)、华纳唱片(Warner Music)和索尼音乐(Sony Music)设立的合资公司。协议终结了这家在中国互联网流量中占有巨大份额的搜索企业与全球音乐产业多年的争斗。
Baidu, China’s largest online search company by revenue, has reached a deal with three of the world’s largest music rights holders to offer their songs for free download.The agreement with One Stop China, a joint venture between Universal Music, Warner Music and Sony Music, lays to rest years of fighting between the Chinese company, which accounts for the lion’s share of Chinese internet traffic, and the global music industry.
这项协议也有望能从总体上对中国互联网上的侵犯版权现象给予重大打击。
It has also raised hopes that it could deal a significant blow to copyright infringement on the Chinese internet overall.
这三家公司表示：“万仕达的股东将向百度授权使用其曲目，以及即将发行的曲目，包括中文歌曲和外国歌曲，这些曲目可从百度服务器上流媒体播放或下载。”
“OSC shareholders will license to Baidu their catalogues and upcoming new releases, including Chinese songs and international tracks, which can be streamed or downloaded from Baidu’s servers,” the companies said.
三家公司透露，按照协议，百度将按照其运营已久的音乐搜索平台百度MP3，以及百度旗下新的社交音乐平台百度 ting! 上的播放和下载次数，向版权方付费。
Under the agreement, Baidu will pay the rights holders per play and per download through Baidu MP3, the company’s long-established music search platform or on Ting, its new social music platform, the companies said.
这两个服务上的搜索和下载对用户都是免费的。百度5月开通的 ting! 通过广告创收。
However, searches and downloads on both services are free for users. Ting, which Baidu launched in May, is financed by advertising.
国际音乐企业长期抱怨中国猖獗的网上盗版现象。过去一年，一些业内高管曾表达过审慎的乐观，认为中国政府打击侵犯知识产权行为的大范围行动可能终于会产生一些效果。这些打击侵权的行动是迫于中国贸易伙伴的强大压力而启动的。
International music companies have long complained about rampant online copyright piracy in China. Over the past year, some executives have expressed cautious optimism that an extensive government campaign against intellectual property rights violations, begun under strong pressure from China’s trading partners, could for the first time yield some results.
跨国音乐版权持有人曾多次起诉百度，指控其侵犯知识产权，因为中国互联网用户能够通过百度MP3服务搜索盗版歌曲，并从该服务链接的网站下载歌曲。不过中国法庭并未判决百度有罪，原因是这些下载并非源自百度网站。
The multinational music rights holders had repeatedly sued Baidu over alleged intellectual property rights infringement because Chinese internet users could search for pirated songs on Baidu’s MP3 service and then download those from the sites the service linked to. But Baidu had not been found guilty in Chinese courts because the downloads were not from its own site.
除了授权协议之外，这几家音乐公司还签署了一项和解协议，终止了所有针对百度的未结诉讼。
Together with the licensing deal, the music companies signed a conciliation agreement that ends all outstanding litigation with Baidu.
